First American Title Insurance (“First American”) and Fidelity National Title Insurance Company (“Fidelity”) have entered into a Proposed Settlement in the class action lawsuits: Piazza v First American Title Insurance Company, Case No. 3:06 cv 765 (AWT) and Lentint v Fidelity National Title Insurance Company, Case No. 3:06 cv 572 (AWT).

For the purposes of settlement, the Court has certified these cases as class actions and scheduled a hearing for January 6, 2009 to determine whether to approve the settlement as fair, reasonable and adequate. To qualify as a member of the class action, individuals must submit a claim form postmarked no later than November 24, 2008.
